Crucial Legal Notice: Torgify functions STRICTLY as a Technology Platform & Aggregator. We connect buyers with local sellers. We do NOT sell products, we do NOT manage deliveries, and we do NOT process payments through an escrow system.

1. Role of Torgify

  • Torgify provides a digital storefront creation tool for sellers and a discovery catalog for buyers.
  • All transactions, payments, and deliveries occur directly between the Buyer and the Seller.

2. No Liability for Quality or Delivery

  • Torgify assumes NO liability for the quality, safety, legality, or authenticity of products/services listed by sellers.
  • Torgify is not responsible for delayed, missing, or damaged deliveries. Delivery is solely the responsibility of the respective seller or the buyer's pickup arrangement.

3. Dispute Resolution

  • Since payments are made directly to the seller via Cash on Delivery (COD) or Direct UPI, Torgify cannot issue refunds or handle chargebacks.
  • Any dispute regarding a product, payment, or return must be settled directly between the buyer and the seller.

Buyer Policy

In Simple Words: You are buying directly from local shopkeepers. Payments go straight to them. For any complaints or returns, you must speak directly to the seller.

1. Purchasing & Payments

  • When you place an order, the request is sent directly to the seller via the platform or WhatsApp.
  • Payments (COD or Direct UPI) go directly into the seller's account. Torgify does not hold your money.
  • Fraud Prevention: Please verify the seller's identity and product before making advance UPI payments. For physical goods from unknown sellers, Cash on Delivery (COD) or Pay-at-Shop is recommended.

2. Returns, Refunds, and Cancellations

  • No Centralized Refunds: Torgify cannot initiate refunds. You must contact the seller directly using the phone number or WhatsApp link provided in your order history.
  • Return and exchange policies are determined by individual sellers, not by Torgify.

3. Location & Privacy

  • When you use the "Share Location on WhatsApp" feature, your exact GPS coordinates are sent directly to the seller to facilitate delivery. Do not share your location with suspicious or unverified contacts.

Seller Policy

In Simple Words: You are responsible for your own products and customers. Torgify charges no commission, but any illegal or fraudulent activity is strictly prohibited. Your shop will be deleted immediately if this happens.

1. Independent Contractor Status & Legal Standing

  • You operate as an independent merchant and business owner. You are not an employee, legal agent, franchise, or partner of Torgify.
  • You retain sole legal responsibility for catalog creation, inventory management, order processing, pricing, quality assurance, and customer satisfaction.

2. Mandatory FSSAI & Regulatory Compliance

  • Food Safety & FSSAI License: Any seller offering cooked food, beverages, groceries, dairy, bakery items, or packaged food must hold a valid registration or license issued by the Food Safety and Standards Authority of India (FSSAI).
  • Sellers are 100% legally liable for food quality, hygienic preparation, non-adulteration, and compliance with shelf-life/expiry date mandates under Indian law. Torgify holds zero liability for food safety violations.

3. Taxation, Invoicing & GST Compliance

  • Sellers are independent tax entities responsible for calculating, collecting, and remitting all applicable Goods and Services Tax (GST), TCS under Section 52 of the CGST Act, and municipal levies.
  • Sellers must provide valid tax invoices/bills directly to buyers upon request for all fulfilled orders.

4. Price Parity & Fair Pricing Guarantee

  • Sellers agree to maintain transparent pricing and avoid price gouging. Listed product prices on Torgify must not exceed the Maximum Retail Price (MRP) or the physical store shelf price.

5. Prohibited & Restricted Products

Sellers strictly CANNOT list, offer, or sell the following categories:

  • Illegal drugs, narcotics, prescription-only medicines without license, or unapproved health supplements.
  • Firearms, weapons, explosives, fireworks, or hazardous chemical substances.
  • Stolen items, counterfeit goods, or copyright-infringing replicas of branded products.
  • Pornographic, obscene, or adult-oriented merchandise.
  • Alcohol or tobacco products without clear display of valid statutory licenses.
  • Expired, spoiled, damaged, or tampered consumer goods.

6. Customer Data Protection & Anti-Spam Rules

  • Buyer contact information (name, phone number, location) provided for an order must be used STRICTLY for order fulfillment and delivery coordination.
  • Sellers are prohibited from transmitting unsolicited promotional SMS/WhatsApp messages, selling buyer data, or engaging in harassment. Violations will result in permanent account termination.

7. Intellectual Property & Marketing License

  • Sellers grant Torgify a non-exclusive, worldwide, royalty-free license to feature their business name, logo, storefront imagery, and catalog listings across Torgify digital properties, search engines (Google Shopping), advertisements, and promotional media.

8. Fulfillment, Disputes & Account Suspension

  • Sellers agree to process accepted orders within reasonable timeframes and maintain high service standards.
  • Torgify reserves the right to immediately suspend or ban any shop account receiving recurring buyer complaints regarding fraud, non-delivery, or fake listings.

Privacy Policy

1. Data Collection

  • Buyers: We collect your phone number, name, and delivery address to facilitate orders. Location data (GPS) is only accessed when you explicitly permit it for calculating delivery distance or sharing with sellers.
  • Sellers: We collect your business details, contact information, and exact shop coordinates to display to buyers.

2. Data Usage & Sharing

  • We do not sell your personal data to third-party ad networks.
  • Buyer-Seller Sharing: To facilitate local commerce, a buyer's contact details and address are shared with the seller when an order is placed. Similarly, the seller's contact details are public.

3. Data Security

  • While we use standard encryption to protect your data, no internet transmission is 100% secure. You share information at your own risk.

Terms of Service

1. Acceptance of Terms

By registering on torgify.com as a buyer or seller, you agree to abide by these Terms of Service. If you do not agree, you must immediately cease using the platform.

2. Platform Modifications & Uptime

Torgify reserves the right to modify, suspend, or discontinue any feature of the platform at any time without prior notice. We do not guarantee 100% server uptime and are not liable for business losses due to technical outages.

3. Right to Terminate

Torgify administrators retain the absolute right to terminate or suspend any user account (buyer or seller) without warning if we suspect fraudulent activity, violation of policies, or abusive behavior.

4. Governing Law

These terms shall be governed by the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the competent courts in Banaskantha, Gujarat, India where Torgify's operating entity (Parmeshvar International) is registered.

Shipping & Delivery Policy

Hyperlocal Delivery & Store Pickup: Torgify connects buyers directly with nearby verified local shops. Products are fulfilled via Free Store Pickup or Direct Local Delivery.

1. Fulfillment Methods & Shipping Costs

  • Free Store Pickup: Buyers can order online and pick up items directly from the seller's physical shop with ₹0 delivery fee.
  • Local Seller Delivery: Sellers fulfill local orders within their operating radius (0–15 km). Standard shipping charges, if applicable, are clearly displayed at checkout.

2. Delivery Timeframes & Handling Times

  • Order Handling Time: 0 to 1 Business Day (Orders placed before 5:00 PM IST are processed the same day).
  • Transit / Delivery Time: 1 to 3 Business Days (Same-day express local delivery available depending on seller distance).
  • Live Tracking & Updates: Buyers receive seller contact details and WhatsApp status updates to coordinate convenient delivery times.

Return & Exchange Policy

Standard 7-Day Free Return Policy: Torgify provides a hassle-free 7-day return and exchange policy. Eligible items can be returned or exchanged within 7 days of delivery at no extra shipping cost to the customer.

1. Return Window & Eligibility

  • Return Window: Customers can request a return or replacement within 7 days of delivery.
  • Item Condition: Items must be returned unused, unwashed, undamaged, and in original packaging with tags intact.

2. Return Shipping Fee & Methods

  • Return Shipping Cost: FREE Return Shipping. Customers are not charged any return shipping or restocking fees for eligible 7-day returns.
  • Return Method: Returns can be fulfilled via doorstep courier pickup or direct return to the local seller's store location.

3. Refund Processing & Timelines

  • Refund Mode: Refunds are credited back to the customer's original payment method (Bank Account, Direct UPI, or Cash).
  • Refund Timeline: Once the returned item is inspected and verified, refunds are processed within 3 to 5 business days.
